In continuing to use this site or purchasing from Sirens and Angels you acknowledge and agree to be bound by these terms and conditions and agree to these terms and conditions overriding any other contract or agreement involved in the transaction. If you do not do so you should exit this site immediately.

To be eligible to purchase Products on this Website you must: be over 18 years of age; provide your real name, phone number, email address and other requested information; provide a valid delivery address.

(Please note that PO box numbers, hotels and temporary accommodation addresses are not acceptable).

Sirens and Angels LLC does not represent or warrant that the functions contained in the site will be uninterrupted or error-free, that the defects will be corrected, or that this site or the server that makes the site available are free of viruses or other harmful components. Sirens and Angels LLC does not make any warrantees or representations regarding the use of the materials in this site in terms of their correctness, accuracy, adequacy, usefulness, timeliness, reliability or otherwise. For safety reasons, all of our products are designed to fail when over stressed.

Strung items of jewelry will require restringing occasionally and this is a characteristic of the jewelry type; it is not a design fault. We are able to restring any item of Sirens and Angels or Biographie jewelry free of charge however all components of the piece must be returned to us; we are unable to restring or repair partial items.

Please note that our products are not intended for heavy use. It is the buyers responsibility to assess the suitability of the product for its intended use and to arrange safe use of the product. Sirens and Angels t/a Biographie accepts no liability for any claim arising from the unsuitability or misuse of any of our products or from faulty products.

We recommend that all customers purchase adequate insurance coverage for their jewelry as we can not be held accountable for or accept any liability for the loss of your jewelry, however caused, once it is in your possession.

Please note that as our products are handmade using precious metals, tarnishing of the metals is to be expected as this is a characteristic of the metal and beyond our control. We are unable to accept any liability for any claim arising from the tarnishing or discoloration of any of the metals used in our products. We will however provide care advice and cleaning advice if required.

MADE TO ORDER / ALTERED ITEMS: We rely on the accuracy of your measurements when ordering made-to-measure products. We do not accept liability for any inaccurate measurements provided by you. Made-to-Order Products will be made specifically to your order in accordance with the instructions and specifications you have given us. It is your responsibility to check all details and aspects of your order are correct and suitable for your requirements, including measurements, dimensions, Product features and delivery. It is the buyer’s responsibility to assess the suitability of the product for its intended use and to arrange safe use of the product. Sirens and Angels t/a Biographie accepts no liability for any claim arising from the unsuitability or misuse of any of our products.

PRODUCT DESCRIPTIONS & COLORS: Every effort is made to ensure that the Products we supply correspond as closely as possible to the samples shown on this Website but they might not be exactly the same. We regret that no responsibility can be accepted for these slight variations which all add to the unique features of our Products including but not limited to the following:

* All measurements are approximate; please allow +/- 2cm variance on sizes stated. * Every reasonable effort is made to ensure the accuracy of color representations; color may vary in accordance with the settings of your device screen, software, or printer.

Every reasonable effort is made to check the provenance of all gemstones sold and to ensure that all gemstones are genuine earth mined gems and that all color treatments, treatments of any kind and flaws are fully disclosed. It is not commercially viable to lab test every gemstone we sell and we rely on a trusted network of suppliers to supply genuine gemstones, which we purchase and sell in good faith. We are unable to guarantee the provenance or value of any gemstone or item of jewelry sold or offered for sale and we are unable to accept any liability for any difference in quality or provenance determined by any other independent source. If a gemstone is found to differ from its description we will offer a replacement where possible, an alternative item or store credit.

The value of gemstones and precious metals fluctuates and we are not able to accept any liability for any future fluctuation in the value of any item purchased.

Typographical Errors
In the event that a Sirens and Angels LLC product is mistakenly listed at an incorrect price, Sirens and Angels LLC reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Sirens and Angels LLC reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Sirens and Angels LLC shall issue a credit to your credit card account in the amount of the incorrect price. We reserve the right to withdraw any Products from this Website at any time and/or remove or edit any materials or content on this Website. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any Product from this Website whether or not that Product has been sold; removing or editing any materials or content on the Website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

PRICES & PAYMENT METHODS:

All prices are in US Dollars and are inclusive of tax at the current rates. Approximate prices may be displayed in other currencies to assist you however the currency conversion rate is estimated. The transaction will be processed in US dollars and we will not be liable to you or any third party for any currency fluctuations or currency exchange rates charged by your payment provider.

Sirens and Angels LLC / Biographie currently only accepts payment via credit/debit card or via paypal.

No order is binding on you or Sirens and Angels until we have accepted it and received payment in full. All title and ownership to the ordered Goods will pass to you from the moment they are dispatched by us to the postal service, or to our carriers, or on payment in full by you of the price of the Goods and any delivery charge (if applicable); and risk will pass on delivery.

We reserve the right to cancel any order due to incorrect pricing, incorrect stock levels or any other reason which will prevent us from supplying the product at the advertised price.

CANCELLATIONS, RETURNS & REFUNDS:

ORDER CANCELLATIONS:

Standard Products: You have the right to cancel your order at any time before you receive the products you ordered. If these Products have already been dispatched when you contact us, you will be advised to return them upon delivery at your own expense, subject to a 20% restocking fee.

Made-To-Order Products and Altered Products: If you need to amend or cancel your order for Made-to-Order Products you are entitled to do so at any time up to 48 hours after you have placed your order. If you amend or cancel your order more than 48 hours after you placed it, we reserve the right to charge you any costs we incur in relation to your order.

RETURNS / REFUNDS:

We are currently not accepting any returns due to Covid.  Please do not place an order unless you are willing to accept this temporary policy.

You may return most new, unopened items within 3 days of delivery for a refund. Please note that returns (excluding faulty or incorrect items) will be subject to a restocking fee of 20%.

For hygeine reasons we are unable to accept returns of earrings except in cases of faulty or incorrect items.

Please note that we do not accept returns of made to order items.

You should expect to receive your refund within four weeks of return, however, in many cases you will receive a refund more quickly. This time period excludes the transit time for us to receive your return from the shipper.

If you need to return an item, please Contact Us with your order number and details about the product you would like to return. We will respond quickly with instructions for how to return items from your order.

In cases of items returned to us by the postal service due to failed delivery attempts, you will be responsible for the cost of redelivery. 

COMPETITION PRIZES:

We do not accept returns of competition prizes. No refunds will be offered for competition prizes and their purchase price will be stated as $0. Competition prizes may not be exchanged. No cash alternatives are available to the prize offered. No partial refund will be given if the competition prize chosen by the winner is less than the stated value of the available prize. Sirens and Angels Gift Vouchers won in competitions may be used in part payment for an item of greater value than the value of the gift voucher. If a gift voucher is used in part payment, only the additional payment will be eligible for a refund and not the value of the gift voucher. If an amount of money is offered as a competition prize it is to be spent on www.sirensandangels.com in full or part payment for ONE single item and cannot be used to purchase multiple items. No cash alternative will be given. No change will be given if the prize chosen is less than the prize value offered.

By entering any competition offered by or in partnership with Sirens and Angels or Biographie you agree to be bound by the terms and conditions stated on this website.

DELIVERY:

In cases of items returned to us due to failed delivery it will be the customers responsibility to arrange and pay for re-delivery.

DELIVERY TIMES

Delivery times are estimated are not guaranteed however we will do our utmost to ensure goods are delivered within the stated time. We shall not be liable for delays or failures in delivery caused by a failure to gain access to the delivery address on the agreed delivery date or failure to obtain a signature or because of other circumstances beyond our reasonable control. Specific delivery times and days cannot be agreed at any time in the order process.

All deliveries are handled by USPS or Fedex and all delivery dates quoted are provided by USPS or Fedex and we shall not accept any liability for any inaccuracies in this information. We shall not be liable for any delays to delivery times or any failure to deliver any item. The delivery time frames quoted by Fedex and USPS and their failure to meet these deadlines is completely out of our control.

RISK & PROPERTY:

We carry the risk of loss or damage to the products until you receive them. If you return the products to us for any reason, they will become our property and be at our risk from the time at which we receive them.

UNDELIVERED ITEMS: An item is only considered to be lost in the mail when it has remained missing for the period of time specified by the mail carrier and is confirmed as missing by the mail carrier. When an item is confirmed as missing by the mail carrier the customer will receive a replacement where available or a refund from the proceeds of the mail carriers compensation scheme.

FORCE MAJEURE:

We will not be held responsible for failure or delay in the carrying out of our obligations under the contract arising from any cause outside our reasonable control or by inability to procure materials or articles except at higher prices due to any such cause and in such circumstances we shall be entitled by notice to terminate the contract in whole or in part without incurring any liability whatsoever to you.

Term; Termination
These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Sirens and Angels LLC t/a Biographie without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Notice
Sirens and Angels LLC may deliver notice to you by means of e-mail, a general notice on the site, or by other reliable method to the address you have provided to Sirens and Angels LLC.

Miscellaneous

JURISDICTION: These terms and conditions and your use of the site will be governed by and interpreted in accordance with the laws of Colorado and no proceedings arising out of this site or your use of it shall be commenced in any other jurisdiction unless Sirens and Angels LLC shall so elect. You accept the jurisdiction of the Colorado Courts in respect of where in the world you may have accessed the site from or you are located.
